These Terms of Use ("Terms") form an agreement between you and Herbi ("Herbi", "the app", "we", "us") and govern your use of the Herbi mobile application. Herbi is a meal planning app that creates weekly meal plans, recipes, nutritional estimates, and supermarket shopping lists based on the preferences you choose. By downloading, accessing, or using Herbi, you agree to be bound by these Terms. If you do not agree with them, please do not use the app.
Herbi helps you plan your weekly food shop. You select a supermarket, a weekly budget, cooking styles ("vibes"), dietary needs, and the kitchen appliances you own, and Herbi generates a meal plan with recipes, cook times, servings, cost estimates, nutritional information, dish images, and a categorised shopping list. You can swap individual meals, review your plan history, and tick off items as you shop. Herbi is a planning and inspiration tool, not a substitute for professional advice.
You must be at least 13 years old, and old enough to enter into a binding agreement in your country of residence, to use Herbi. By using the app you confirm that you meet these requirements. Herbi is intended for personal, non-commercial use.
Meal plans, recipes, ingredient lists, nutritional values, cost estimates, and images in Herbi are produced by an automated artificial intelligence system. This content is provided for general guidance only and may contain inaccuracies. Prices shown are estimates and will not always match the actual prices at your chosen supermarket, which can change at any time. Nutritional figures are approximate and should not be relied on for medical, clinical, or precise dietary purposes. You are responsible for checking ingredients and recipes against your own needs.
You are solely responsible for verifying that any meal, ingredient, or recipe is safe and suitable for you and anyone you cook for. While Herbi lets you set dietary preferences such as vegetarian, vegan, gluten free, or dairy free, it cannot guarantee that generated recipes are free from allergens or fully meet a specific medical diet. Always read product labels, follow safe food handling and cooking practices, and consult a qualified professional if you have allergies, intolerances, or medical dietary requirements. Herbi is not responsible for any adverse reaction resulting from food you prepare or consume.
Herbi offers an auto-renewable subscription that unlocks premium features. Subscriptions are sold through the Apple App Store and billed to your Apple ID. Payment is charged to your iTunes account when you confirm the purchase. Your subscription renews automatically unless auto-renew is switched off at least 24 hours before the end of the current period, and your account is charged for renewal within the 24 hours before the period ends. You can manage or cancel your subscription at any time through your Apple account settings. If a free trial is offered, the full subscription price will be charged when the trial ends unless you cancel beforehand. Cancelling stops future renewals but does not retroactively refund the current period.
Purchases made through the App Store are handled by Apple, and refund requests are subject to Apple's policies rather than processed directly by Herbi. If you submit a refund request for a Herbi purchase, we may be required to provide Apple with information related to that transaction so the request can be reviewed. This may include details such as the length of time the app was actively used, an anonymized user identifier that is not linked to your real identity, the total amount you have spent in the app, and the total amount already refunded to you. We share this information only to assist with assessing and processing refund requests.
You agree to use Herbi only for lawful purposes and in line with these Terms. You must not attempt to reverse engineer, decompile, copy, resell, or otherwise exploit the app or its content beyond personal use; interfere with or disrupt the app or its backend services; attempt to gain unauthorised access to any part of the service; or use the app in any way that could harm Herbi, its providers, or other users. We may suspend or restrict access if these Terms are breached.
Herbi and its design, branding, software, and original content are owned by us or our licensors and are protected by applicable intellectual property laws. These Terms do not transfer any ownership rights to you. You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to use the app for your own meal planning. Meal plans and shopping lists generated for you may be used for your personal cooking and shopping.
Herbi relies on third-party services to function, including a backend service that runs the artificial intelligence used to generate plans and images, Apphud for subscription management, and the Apple App Store for purchases. Your use of these services may also be subject to their own terms and policies. We are not responsible for the practices of third parties, but we work with providers that support the app's intended functionality.
Herbi is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that generated content will be accurate, complete, or suitable for any particular purpose. Your use of the app and reliance on its content is at your own risk.
To the maximum extent permitted by law, Herbi and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or inability to use the app, including reliance on meal plans, prices, nutritional information, or recipes. Where liability cannot be excluded, it is limited to the amount you paid for the app in the twelve months before the event giving rise to the claim.
We may update, change, or discontinue features of Herbi at any time, and we may revise these Terms from time to time. When we make a meaningful change to these Terms, we will update the "Last updated" date above. Your continued use of Herbi after a change takes effect means you accept the revised Terms.
You may stop using Herbi and delete the app at any time. We may suspend or end your access to the app or its services if you breach these Terms or use the app in a way that could cause harm. Provisions that by their nature should survive termination, such as intellectual property, disclaimers, and limitation of liability, will continue to apply.
These Terms are governed by the laws applicable in your country of residence to the extent required, and otherwise by the laws under which Herbi operates, without regard to conflict of law principles. Nothing in these Terms removes any statutory consumer rights you may have that cannot be waived.
